1.4. The Terms apply to every visitor of the Website (hereinafter: the User). By using the Website, the User accepts the provisions of the Terms.

1.5. The processing of personal data is governed by the Privacy notice, and data stored in the browser by the Cookies and storage page. These apply together with the Terms.

2. Purpose and nature of the Website

2.1. The Website presents the technologies and projects represented by Real Energy Group (in particular THE CAN, SynergAqua, RealEnergyHomes and TERRABotanic) and provides the means to get in touch, request an invitation, submit a referral and provide data through the data request form.

2.2. The content of the Website is provided for information purposes only. It does not constitute an offer, an invitation to make an offer, an investment offer, investment advice, or a technical or expert opinion. A contract is concluded exclusively by a separate written agreement between the parties.

2.3. The technical data, performance values, references and savings figures shown on the Website relate to the specific circumstances concerned; conclusions regarding a particular project may be drawn only on the basis of an individual assessment and a written offer.

3. Languages of the Website and translations

3.1. The Website is available in sixteen languages. The original language of the Website is Hungarian.

3.2. The versions in languages other than Hungarian are translations and are provided for information purposes only. Linguistic or substantive discrepancies may occur in the course of translation.

3.3. In the event of any discrepancy between the Hungarian version and a version in another language, the Hungarian version shall prevail.

3.4. To the fullest extent permitted by law, the Operator accepts no liability for any linguistic or substantive discrepancies arising from translation or for any consequences thereof.

4. Use of the Website

4.1. The public part of the Website may be used free of charge and without registration.

4.2. The User shall use the Website in accordance with its intended purpose and with the applicable laws. In particular, the following are prohibited:

a) obstructing or overloading the operation of the Website, or circumventing its security measures;

b) providing another person's data without authorisation, or acting on behalf of another person;

c) providing false or misleading data in the forms;

d) uploading files containing malicious code.

4.3. The Operator may modify, suspend or discontinue the Website or any part of it without prior notice.

5. Requesting an invitation, referrals, login

5.1. On the Login page, the User may request an invitation or submit a referral. Requesting an invitation or submitting a referral does not give rise to any right to access, cooperation, commission or a contract. Requests and referrals are reviewed by a member of the Operator's staff.

5.2. When submitting a referral, the User warrants that they are entitled to refer to the referred person or organisation and that they have informed the referred person that they are providing that person's data for the purpose of making contact.

5.3. An invitation code may be used only once and is linked to the invited e-mail address. An invitation code may not be transferred to another person.

5.4. The staff and admin interface is accessible only to designated staff members and administrators.

5.5. Partner access is available by invitation only. Requesting access does not in itself constitute access or cooperation.

6. The THE CAN data request form

6.1. The data request form and document downloads are opened with a single-use code sent to the e-mail address and valid for 15 minutes.

6.2. The User warrants that the data provided and the documents uploaded are genuine and that the User is entitled to provide or upload them. The User is liable for any content that infringes the rights of third parties (in particular trade secrets, copyright or personal data).

6.3. The Operator stores data request forms that have been started but not finally submitted, together with the related documents, for no more than 30 days and then deletes them automatically; 5 days before deletion, the Operator sends a single reminder by e-mail.

6.4. A submitted data request form is subject to final registration and to verification by the designated legal representative; this must be acknowledged on submission. After submission, the Operator sends a single registration invitation. If registration is not completed within 14 days of submission, the submission expires and no indicative offer can be sent for it.

6.5. Submitting the data request form does not constitute an offer and does not oblige the Operator to make an offer. Any indicative offer is not binding; a contract is concluded only by a separate written agreement.

6.6. Documents downloadable from the Website may be confidential. The User may use them solely to evaluate the User's own project and may pass them on to third parties only with the Operator's prior written consent.

7. Intellectual property

7.1. The entire content of the Website (text, images, videos, graphics, logos, layout, source code) is protected by copyright and other intellectual property rights. The content is the property of the Operator, of the members of Real Energy Group, or of the right holders of the technologies they represent.

7.2. The names THE CAN, SynergAqua, RealEnergyHomes and TERRABotanic and the related logos are trade marks or brand names of their respective right holders; their use is permitted only with the prior written consent of the right holder.

7.3. Viewing the content for private purposes and referring to it with acknowledgement of the source are permitted. Any further use (reproduction, adaptation, distribution, communication to the public) requires the Operator's prior written consent.

8. Liability

8.1. The Operator endeavours to keep the content of the Website accurate and up to date, but does not warrant its completeness, accuracy or continuous availability.

8.2. To the fullest extent permitted by law, the Operator is not liable for any damage arising from decisions based on the content of the Website, from the unavailability or malfunction of the Website, or from faults occurring on the User's device. Liability for damage caused intentionally or through gross negligence, or by a breach of contract resulting in harm to life, physical integrity or health, cannot be excluded.

8.3. The Operator is not responsible for the content of external links found on the Website.

9. Complaints and contact

9.1. Questions and complaints concerning the Website may be sent to info@realenergy.group. The Operator examines complaints within a reasonable time and responds in writing.

9.2. In the case of a data protection complaint, the User may contact the Hungarian National Authority for Data Protection and Freedom of Information (NAIH).

10. Amendment of the Terms

10.1. The Operator is entitled to amend the Terms unilaterally. Amendments enter into force upon publication on the Website. The current version of the Terms and its effective date are available on the Website at all times.

11. Governing law and disputes

11.1. The Terms and the use of the Website are governed by Hungarian law.

11.2. The parties shall seek to settle disputes primarily through negotiation. If this is unsuccessful, the Hungarian court having subject-matter and territorial jurisdiction shall have jurisdiction. Where the User qualifies as a consumer, the mandatory provisions of the law of the User's place of residence and the rights granted by consumer protection legislation may not be restricted.
